European Enforcement Order: enforcing an uncontested claim abroad
When the European Enforcement Order may help with uncontested claims and which cross border checks matter first.
17 August 2026, Mag. Bernhard Brandauer, Rechtsanwalt
If debtor assets are located in another EU country, an Austrian view of the claim is often not enough. For uncontested claims, the European Enforcement Order can be an important review point.
It is not the same as the European Payment Order, small claims procedure or enforcement of a foreign judgment in Austria. The key issue is whether the claim is uncontested and which title exists.
This article is general information for creditors in Austria. It does not replace review of the individual matter and gives no recovery guarantee.

Overview of all answers.
Structure documents first
Structure title, contract, invoice, correspondence, payment schedule and court letters chronologically. Without this basis, the next step remains uncertain.
Review the concrete risk point
Document the concrete debtor reaction and the course of events. Verifiable data, letters and payment flows help more than broad allegations.
Review economics
Open amount, interest, costs, evidence and access prospects should be reviewed together. Not every formally possible step is economically sensible.
Why uncontested claims need a specific EU review
The European Enforcement Order is designed for uncontested claims. This threshold must be taken seriously because disputed facts need different routes.
For creditors, jurisdiction, title, service, certification and practical enforcement in the target state must be separated.
Which documents the firm needs first
For first review, the decisive point is not volume but order. The firm must understand how the claim arose, which title or procedural status exists and how the debtor reacted.
Needed documents include legal basis, evidence that the claim is uncontested, service details, title and known debtor data in the target state.
Legal framework
The review framework includes Regulation (EC) No 805/2004, Brussels Ia and Austrian enforcement rules.
The rules mentioned are a review framework, not an automatic solution. The right route depends on title, procedure status, evidence, objections and economic sense.
Practical note: Note the target country, known address, possible assets and whether the debtor ever disputed the claim.
Typical mistakes creditors should avoid
The term EU enforcement is often used too broadly. If European Payment Order, Enforcement Order and Brussels Ia are confused, the first step can be wrong.
A factual presentation is better: what is securely evidenced, what is disputed, what remains open and which concrete step should be reviewed?
